Policy maturity and client communication have not kept pace, and clients are starting to ask.

Adoption is well advanced

LexisNexis’ AI Sentiment Survey of the Australian and New Zealand profession found that more than 69% of legal professionals were already using or planning to use generative AI, with confidence in the technology rising from 75% in 2023 to 90% in 2025. Small firms were leading adoption, using it to stay competitive, while larger firms and government departments invested more cautiously in order to balance innovation against compliance.

That pattern matters for marketing. In Australia, the small firm is often ahead of the large one on practical adoption, which means the small firm has something specific and true to say about it.

What clients will ask, and soon

As adoption becomes visible, prospective clients will start asking how a firm uses technology, how information is protected, who reviews output, and whether pricing reflects work that is partly automated. Firms need plain-language answers rather than positioning statements.

A credible page says something close to this, reviewed for the firm’s jurisdiction and practice: approved technology may support administrative and legal workflows; lawyers remain responsible for advice and work product; confidentiality, review and escalation processes apply. What makes it credible is the specificity and the willingness to name limits.

The rules baseline

The Australian Solicitors’ Conduct Rules framework requires that legal advertising is not false, misleading, deceptive, offensive or prohibited by law. That is a broad standard and unsupported AI performance claims sit squarely inside it. Any statement that technology produces faster outcomes, better results or lower costs needs substantiation the firm can actually produce.

The accuracy question is not hypothetical either. A Stanford RegLab study published in the Journal of Empirical Legal Studies found leading purpose-built legal research AI tools producing hallucinated output between 17% and 33% of the time. A firm that markets on AI accuracy is making a claim the published research does not support.

The positioning that works

Do not market the tool. Market the process around it: what is approved, what is reviewed, what remains human, and what the client can expect. In a market where adoption is high and governance is uneven, being the firm that can explain its process is the differentiator.

LexisNexis’ AI Sentiment Survey found more than 69% of legal professionals in the region already using or planning to use generative AI, with confidence rising from 75% in 2023 to 90% in 2025 and small firms leading adoption.
